1. Who we are

Grow Now Marketing (“Grow Now Marketing,” “we,” “us,” or “our”) is a marketing services business operating at 61 Spring St., Tarrytown, New York. We provide paid advertising, funnel and follow-up systems, and AI chat and voice agent services to business clients.

This Privacy Policy explains how we collect, use, and share personal information when you visit grownowmarketing.com and our other websites and landing pages, fill out our forms, call or text us, book an appointment with us, or otherwise interact with our marketing.

This policy covers information we collect for our own business. It does not cover information we handle on behalf of our clients as a service provider. Section 8 explains that distinction.

2. Information we collect

Information you give us directly. When you fill out a form, request a consultation, book a call, subscribe to a list, or contact us, we may collect your name, email address, mobile and landline phone numbers, business name, website URL, and anything else you choose to tell us in a message or on a call.

Information collected automatically. When you visit our sites we and our analytics and advertising partners may collect your IP address, device and browser type, operating system, referring URL, pages viewed, time on page, and similar usage data, using cookies, pixels, and comparable technologies.

Information from third parties. We may receive information about you from advertising platforms, lead sources, form and scheduling tools, and publicly available business sources.

We do not intentionally collect sensitive personal information such as government identification numbers, financial account numbers, health information, or precise geolocation. Please do not send us that information through our forms or messages.

3. SMS and text messaging

If you provide your mobile number and opt in, we may send you text messages relating to appointments, follow-up on an inquiry, service updates, and marketing about our services.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories of information exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

We share mobile numbers only with the communications platforms and carriers that are strictly necessary to deliver the messages you asked for, and those providers are not permitted to use your number for their own marketing.

Consent is not a condition of purchase. You do not have to agree to receive texts in order to buy anything from us.

Opting out. Reply STOP to any message to stop receiving texts. Reply HELP for help, or contact us at kyle@grownowmarketing.com. Message frequency varies. Message and data rates may apply.

Our SMS program terms are set out in our Terms of Service.

4. Phone calls, AI voice agents, and call recording

We may contact you by phone at a number you provide, and you may reach us by phone.

Automated and AI-assisted calls. Some calls to or from us may be placed or answered by an automated system or an artificial intelligence voice agent rather than a human. Where a call is handled by an AI agent, we disclose that fact at the start of the call. You can ask to be transferred to a person at any time.

Call recording and transcription. We may record and transcribe calls for quality, training, scheduling, and record-keeping. Where a call is recorded, we disclose the recording at the start of the call and you may decline. If you do not consent to being recorded, tell us and we will either end the recording or continue without it. Recordings and transcripts are handled under this policy and are retained as described in Section 11.

Opting out of calls. Ask us to stop calling, or email kyle@grownowmarketing.com, and we will add you to our internal do-not-call list.

5. How we use information

We use personal information to:

  • respond to inquiries and provide the services you request
  • schedule, confirm, remind you about, and follow up on appointments
  • send you marketing about our services where you have consented or where permitted by law
  • operate, maintain, secure, and improve our websites and funnels
  • measure and optimize our advertising
  • create invoices, take payment, and keep business records
  • comply with legal obligations and enforce our agreements

6. How we share information

We share personal information with:

  • Service providers who work on our behalf, including hosting, CRM and marketing automation, scheduling, telephony and SMS delivery, email delivery, analytics, payment processing, and professional advisers
  • Advertising and analytics partners, as described in Section 7
  • Legal and safety recipients, where we believe disclosure is required by law, legal process, or to protect our rights, property, or safety or that of others
  • A successor entity, in connection with a merger, acquisition, financing, or sale of assets

We do not sell your personal information for money.

The mobile information carve-out in Section 3 applies to every category in this section.

7. Advertising, analytics, and cookies

We use cookies, pixels, and similar technologies, including the Meta pixel and Google Analytics, to understand how people use our sites and to deliver and measure advertising. This may involve sharing identifiers and browsing activity with advertising platforms.

Under California law, this kind of disclosure to advertising partners for cross-context behavioral advertising is treated as “sharing” of personal information, even though we receive no money for it. Section 10 explains how to opt out.

Most browsers let you block or delete cookies. Blocking them may affect how our sites work. We currently do not respond to browser Do Not Track signals, but we do honor Global Privacy Control signals as an opt-out of sharing.

8. Information we process for our clients

When we run advertising, funnels, follow-up systems, or AI agents for a business client, that client’s customer and lead data flows through systems we configure and operate.

For that data, our client is the business responsible for it and we act as a service provider under their instructions. We use that data only to deliver services to that client and do not sell it, share it for cross-context behavioral advertising, or use it for our own marketing.

If you interacted with one of our clients and want to exercise privacy rights over your information, contact that business directly. If you reach out to us, we will forward your request to the relevant client where we can identify them.

9. Data retention

We keep personal information for as long as needed for the purposes described in this policy, and afterward for as long as we need it for legal, tax, accounting, and dispute-resolution purposes.

SMS and call consent records are kept for as long as you remain opted in, and for a period afterward sufficient to evidence that consent was given.

Call recordings and transcripts are retained for as long as needed for the purposes described in this policy and for legal and record-keeping requirements.

10. Your California privacy rights

If you are a California resident, the California Consumer Privacy Act as amended by the CPRA gives you the following rights:

  • Right to know what personal information we collect, use, disclose, and share, including the categories and specific pieces
  • Right to delete personal information we hold about you, subject to exceptions
  • Right to correct inaccurate personal information
  • Right to opt out of sale or sharing of your personal information
  • Right to limit the use and disclosure of sensitive personal information
  • Right to non-discrimination for exercising any of these rights

Categories we collect. Identifiers (name, email, phone, IP address); commercial information (services inquired about or purchased); internet and network activity (browsing and interaction with our sites and ads); audio information (call recordings); and professional or employment-related information (business name and role).

How to exercise your rights. Email kyle@grownowmarketing.com with the subject line “California Privacy Request,” or write to us at the address in Section 14. We will verify your identity by matching the information in your request against our records, and may ask for additional information. You may use an authorized agent, who must provide written proof of authorization.

Do Not Sell or Share My Personal Information. To opt out of sharing for cross-context behavioral advertising, email kyle@grownowmarketing.com with the subject line “Do Not Share,” or send a Global Privacy Control signal from your browser.

We will respond to verifiable requests within the timeframes required by law, generally 45 days, with one extension where permitted.

11. Security

We use reasonable administrative, technical, and physical safeguards to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

12. Children’s privacy

Our services are for businesses and are not directed to anyone under 18. We do not knowingly collect personal information from children. If you believe a child has given us personal information, contact us and we will delete it.

13. Third-party sites

Our sites and messages may link to sites we do not operate. We are not responsible for their privacy practices. Read their policies before providing information.

14. Changes to this policy

We may update this policy from time to time. We will change the “Last updated” date at the top, and where the changes are material we will provide additional notice. Your continued use of our sites and services after an update means you accept the revised policy.
